At the August 24, 2011 meeting of the Alamosa County Board of Commissioners, Alamosa County changed the Zoning designation for most of Unit III from Commercial to Residential.
Lots zoned Residential are Unit III, Block 1, Lots, 1, 2, 3, 4, 5, 6, 7, 8, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24; Block 2, Lots 1, 2, 3, 4; Block 3, Lots 1, 2, 3, 4, 5, 6, 7; Block 4, Lots 1, 2, 3; and Unit III the eastern 3.85 acres of Tract B.
Unit III, Block 5, Lot 1; Block 1, Lot 25 remain zoned Commercial along with 10 lots in the northern tip of Unit III, Block 1, Lots, 9, 10, 11, 12, 13; Block 3, Lots 8, 9, 10; Block 4, Lots 4, 5.
The ZHA Board had represented to Alamosa County that it is the will of the membership to have limited commercial operations only in the northern most tip of Unit III, the rest of Unit III being residential; this was the overwhelming response of all members who responded to the 2008 poll.
If the County Commissioners had not approved the rezoning application on August 24, 2011, those ZHA members who wished to develop their Unit III land as Residential would have continued to be harmed, as they could not develop their land at all, as long as the zoning conflict continued with the Association’s Covenants. With the County Commissioners vote for the rezoning application, both the Commercial and the Residential land will be able to be developed or sold, and be productive for both the individual owners and Alamosa County.
The Association still has to work out an agreement with Water Division 3 as to how the Commercial Water will be permitted by the State. The Water Committee is beginning the process of working on a proposal that has been submitted to the Division for the allocation of Commercial Water well permits on the basis of Commercial Use. Currently the Division believes permits are limited by acreage language in our Water Decree.
